Time Limit for Filing a Wrongful Death Claim in Burlington, CT

In Burlington and throughout Connecticut, families have two years from the date of death to file a wrongful death claim. Courts strictly enforce this deadline in wrongful death cases. Missing this window can eliminate the right to seek compensation entirely.

The two-year period begins on the exact date the person died. So, for instance, if the crash victim passes away on April 2, 2026, the clock starts running on that day. Families in Burlington need to account for this timeline early when planning any legal steps.

Certain situations can affect the standard filing deadline in Connecticut. If the person responsible for the crash is a government entity, shorter notice requirements may apply. Minors or individuals under a legal disability may also have different deadlines under state law.

In Connecticut, only the executor or administrator of the deceased person’s estate holds the legal authority to file a wrongful death claim. If no estate has been opened, a family member may need to petition the court to establish one. Burlington residents should take this step quickly to preserve their options.

A missed deadline in a Burlington, CT, wrongful death case results in the court dismissing the claim. Once that happens, families lose the ability to seek compensation for their loss. No amount of evidence or documentation can revive a case filed after the statute of limitations expires.

Evidence that supports a wrongful death claim in Burlington includes crash reconstruction reports, police documentation, and witness statements. Medical records showing the victim’s injuries before death also play a key role. Photographs from the scene and vehicle damage reports can further establish / show what happened.

A wrongful death lawyer helps families track deadlines and file all required documents on time. An attorney can gather evidence, communicate with insurance companies, and explain what compensation may be available. Legal guidance reduces the risk of missing a required step that could end your claim.
