How Long Do You Have to File a Claim After a Pedestrian Crash in Plainville, CT?
In Connecticut, you have two years from the date of a pedestrian crash to file a personal injury lawsuit. That deadline applies whether you were hit in a crosswalk, on a shoulder, or on an open road. Missing it can permanently prevent you from seeking compensation.
In some cases, the two-year deadline can be extended or paused. If the injured person is a minor or mentally incapacitated, the clock may not start right away. Connecticut also allows extra time if the at-fault driver left the state after the crash.
For elderly pedestrians, the recovery process is longer and more expensive. Broken bones and fractures can take months to heal in older adults. The cost of surgery, rehabilitation, and in-home assistance can add up quickly.
After a crash, keeping detailed records from the very beginning makes a real difference. Save every medical bill, doctor’s note, and receipt tied to your treatment. Written records of missed work days and out-of-pocket expenses also help build a stronger claim.
Because Connecticut follows a modified comparative negligence rule, you can still recover compensation as long as you are less than 51 percent at fault. The driver’s insurance may try to argue that you shared blame. Photos and witness statements can help establish what actually happened.
UM advogado de acidentes de pedestres can help you understand which deadlines apply and how to handle insurance pushback. Legal guidance can make the claims process easier to manage and help you avoid costly mistakes.
