Who Can Be Held Liable for a Construction Scaffolding Fall in Berlin, CT?

A fall from scaffolding can raise questions about whether proper safety equipment, such as guardrails or fall protection harnesses, was in place at the time of the accident. The Berlin Turnpike runs through a stretch of commercial and industrial development connecting to nearby New Britain and Cromwell, an area where construction and renovation projects are common and scaffolding-related incidents can occur.

Under Connecticut law, an injured worker typically pursues compensation through the workers’ compensation system, which covers medical expenses and a portion of lost wages regardless of fault. However, if a general contractor, scaffolding company, or another party separate from the worker’s direct employer contributed to unsafe conditions, a third-party liability claim may also be available, potentially allowing for additional compensation beyond standard workers’ comp benefits.

Falls from height can result in serious injuries, including fractures, spinal damage, or traumatic brain injuries, and recovery can involve months of treatment and rehabilitation. A advogado de danos pessoais can help a worker determine whether a third-party claim applies by reviewing site safety records, OSHA citations, and witness accounts, since this kind of documentation can become harder to obtain as time passes.

At L.A. LAW, our team can help explain how Connecticut’s workers’ compensation laws apply to your case and whether a separate liability claim may be possible. We can also help identify evidence that may support your claim.
