Can a Minor File a Personal Injury Claim in Newington, CT?

Yes. In Connecticut, a minor hurt in a crash caused by a drunk driver can pursue a personal injury claim, typically through a parent or legal guardian acting on their behalf. When the other driver has been arrested for DUI, that arrest can serve as significant evidence of negligence in a civil case, even if criminal charges are later reduced or resolved separately. A personal injury attorney can help the family understand what documentation to gather and what legal options may be available.

Connecticut sets the legal blood alcohol limit at 0.08 percent for drivers 21 and older, and any detectable alcohol for drivers under 21. A DUI arrest does not automatically result in a conviction, but in a civil case the standard of proof is lower than in criminal court. This means a family pursuing a personal injury claim does not need to wait for a criminal verdict to move forward. Evidence gathered during the arrest may be usable in civil proceedings.

Teens involved in DUI-related crashes may face a range of physical and emotional consequences, even when initial injuries appear minor. Soft tissue damage, concussion symptoms, and psychological effects from a traumatic crash can emerge days after the fact, which makes prompt medical evaluation and careful documentation important. A car accident attorney can help ensure that all resulting harm is accounted for when evaluating a potential claim.
