Can a Worker Sue After a Forklift Accident in Berlin, CT?
In Connecticut, workers hurt on the job are generally covered by workers’ compensation, which provides benefits for medical treatment and lost wages regardless of fault. However, workers’ compensation is not always the only option available. In this type of accident, third parties can be involved; this includes forklift manufacturer, a property owner, or a contractor other than the injured worker’s direct employer. If a third party shares fault, the injured person may also have grounds to file a separate personal injury claim. This is sometimes referred to as a third-party claim, and it can allow a person to seek compensation beyond what workers’ compensation alone provides.
Berlin is home to a mix of light industrial, warehouse, and commercial operations, particularly along corridors like Wilbur Cross Highway and the Berlin Tpke. Forklifts are common equipment in these settings and carry significant injury risk when safety protocols are not followed. OSHA regulations require employers to maintain strict standards around forklift operation, operator training, and pedestrian safety in work zones.
Forklift accidents can cause devastating injuries. Crush injuries to the legs, pelvis, and spine can require multiple surgeries, extended rehabilitation, and may result in permanent disability. Victims can face lost income, ongoing medical care, and reduced earning capacity. This financial toll can follow a person for years.
A personal injury attorney can help determine whether a third-party claim is available alongside a workers’ compensation case and what types of compensation may be pursued. Legal guidance can clarify what documentation matters and what steps are available going forward.
