How Is Fault Determined in a Car-Motorcycle Crash in Hartford, CT?

Connecticut follows a modified comparative negligence rule, that means that fault can be divided between drivers based on each person’s actions leading up to the crash. A driver found more than 50% responsible is barred from recovering damages, while a rider assigned partial fault can still recover a reduced amount.

Determining fault typically involves examining traffic signals, right-of-way rules, and witness statements from anyone who saw the crash unfold. Skid marks, vehicle damage patterns, and any available dispatch records can also help reconstruct how the collision happened.

Because motorcyclists are sometimes assumed to be at fault simply due to the nature of their vehicle, a thorough review of the evidence is often necessary to establish an accurate account. A abogado de accidentes de motocicleta can assist in gathering police reports, witness accounts, and other evidence to help determine how fault should be divided. This kind of legal guidance can also help clarify how a partial fault finding might affect a potential claim.

Injuries from these types of crashes can complicate the fault-finding process, since medical records are frequently used to help explain how the collision occurred and how severe the resulting harm was.
