How Long Do Families Have to File a Wrongful Death Claim in Plainville, CT?
In Connecticut, families have two years from the date of death to file a wrongful death lawsuit. The claim is typically brought by the executor or administrator of the deceased person’s estate. Missing that deadline can permanently prevent the family from seeking compensation.
After losing a loved one, families may seek compensation for funeral costs, medical bills, and lost future income. Connecticut law also allows damages for the loss of companionship. The amount depends on the specific facts of each case.
Because Connecticut follows a modified comparative negligence rule, fault division affects the outcome. If the deceased is found 51 percent or more at fault, the family cannot recover. Traffic camera footage and witness statements help establish what happened.
Even when the driver stays at the scene and cooperates, the family may still have grounds to file a claim. A wrongful death lawsuit is a civil matter, separate from any criminal charges. The two processes run independently of each other.
Before agreeing to any insurance payout, families should know the full scope of their losses. Quick settlements often leave out future income and long-term costs. Complete records put the family in a stronger position.
If your family lost a loved one in a pedestrian crash, a abogado de muerte por negligencia can review the crash report and available evidence. An attorney can also explain who may bring the claim and how Connecticut’s deadline applies.
